Privacy Policy



This Privacy Policy (the “Policy”), effective as of March 30, 2016, applies to all visitors to MotorQueen’s Website, and is specifically incorporated by reference in the Terms and Conditions set forth. By using the Website or the Services, as defined in the Terms and Conditions, you are deemed to have consented to the terms of this Policy. Terms used but not otherwise defined in this Policy have the meanings given to them in the Terms and Conditions.

1.0 Personally Identifiable Information. In the course of using the Services provided by MotorQueen, you may be required to provide certain personally identifiable information to us, including your first and last name, mailing addresses (including zip codes), e-mail addresses, telephone and facsimile numbers, and other personally identifiable information. We may gather additional personal or non-personal information in the future. Depending upon the particular Service, some of the information MotorQueen asks you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory information with respect to a particular Service, you will not be able to use or access that Service. However, no personally identifiable information will be collected about you until and unless you provide such information in order to access a Service.

2.0 Non-Personally Identifiable Information. In the course of providing the Website and the Services, MotorQueen may gather certain information that does not specifically identify you. This information may include the Uniform Resource Locators (“URLs”), browser (Internet Explorer, Google Chrome, etc.), Internet Protocol (“IP”) addresses, Machine Access Control (“MAC”) addresses you use to access the Website and the Services. This information may be compiled and analyzed on both a personal and an aggregated basis, and is used for the operation of the Services and to maintain the quality of the Services.

3.0 Sharing of Information. Except as otherwise stated in this Privacy Policy, MotorQueen will not disclose, sell, trade, or rent your personally identifiable information to other parties.

3.1 Dealers. The Services are designed to allow you to find automobiles for sale by dealers and other sellers. Consequently, if you choose to inquire about an automobile listed on the Website by using the Services, we may disclose portions of your personally identifiable information to such third parties in order for them to contact you regarding such automobile. MotorQueen will not disclose your personally identifiable information to any other person using the Services that you do not initiate contact with.

3.2 Government Authorities. MotorQueen may be required by law to provide personally identifiable information to governmental authorities in certain circumstances. MotorQueen will disclose Personally Identifiable Information upon receipt of a court order, subpoena, or other judicial requirement. MotorQueen fully cooperates with law enforcement agencies in identifying persons who use the Services for illegal activities. MotorQueen reserves the right to report to law enforcement agencies any activities that MotorQueen, in good faith and in its sole discretion, believes to be unlawful.

3.3 Credit Card Providers. Credit card transactions are handled by established third party banking, processing agents and distribution institutions. If you use a credit card to pay for MotorQueen Services, MotorQueen will be required to share your personally identifiable information with such institutions in order to verify and authorize your credit card or other payment information.

3.4 Direct Marketing. MotorQueen does not disclose your personally identifiable information to third parties for direct marketing purposes, such as mass mailings of advertisements.

4.0 Security and Protection of Information.

4.1 Personally Identifiable Information. The security of your personally identifiable information is of the utmost importance to MotorQueen. MotorQueen stores all such information in accordance with current industry security standards in order to protect it from unauthorized access, use or disclosure. Access to your own personally identifiable information is available through unique username and password selected by you. Such information is stored on a secure server only accessible by MotorQueen. MotorQueen encrypts personally identifiable information using industry-recognized standards in order to prevent unauthorized parties from viewing such information that a User submits it to MotorQueen.

4.2 Your Responsibility for User Name and Password. You are responsible for maintaining the confidentiality of your username and password. You agree to immediately notify us of any unauthorized use of your password or account or any other breach of security. In no event will MotorQueen be liable for any indirect or consequential loss or damage whatsoever resulting from the disclosure of your username and/or password. You may not use another person’s user account at any time without the express permission of the account holder.

4.3 Transmission of Personally Identifiable Information. When personally identifiable information is transmitted to other parties, such as government authorities, Credit Card Providers, or any other authorized third party, MotorQueen will encrypt such information using industry recognized standards in order to prevent unauthorized parties from viewing such information.

4.4 Other Information. All other information collected by MotorQueen about you also resides on a secure server, which is designed to be accessible only by MotorQueen, subject however to the provisions of Section 4.6 (No Warranties) below.

4.5 Access and User Changes to Information. You may access and update your information at any time via your online account after entering your username and password. MotorQueen encourages you to keep your information current so that MotorQueen may contact you regarding the Services and changes to this Privacy Policy. However, any changes to your information will only be reflected going forward; MotorQueen cannot alter information it has already provided to third parties.

4.6 No Warranties. No data transmission over the Internet or other wireless communication method can be guaranteed to be totally secure. As a result, while MotorQueen will make all commercially reasonable efforts to protect the privacy of your information, both personally identifiable and otherwise, MOTORQUEEN MAKES NO GUARANTEES, REPRESENTATIONS, OR WARRANTIES WHATSOEVER AS TO WHETHER THE PRIVACY OF YOUR INFORMATION WILL REMAIN SO PROTECTED. IN PARTICULAR, THE POSSIBILITY OF HACKERS, CYBER-ATTACKS, OR OTHER INTERNAL OR EXTERNAL UNAUTHORIZED ACCESS THAT MAY COMPROMISE, DISCLOSE OR OTHERWISE JEOPORDIZE YOUR PERSONAL INFORMATION, AND BY USING THE SERVICES OR THE WEBSITE, YOU HEREBY AGREE AND AKNOWLEDGE THE POSSIBILITY THAT IT MAY BE COMPROMISED, DISCLOSED OR JEOPORDIZED. IF YOU DO NOT WISH TO RISK THIS POSSIBILITY, PLEASE DO NOT USE THE WEBSITE OR THE SERVICES. MotorQueen’ obligations with respect to the security of your stored information are set forth hereinabove and in the Terms and Conditions. State laws may also apply to said obligations to secure stored information.

5.0 Use of Cookies.

5.1 Both MotorQueen’s publicly available Website and the pages used to provide the Services may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. MotorQueen does not use cookies to run programs on your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie. save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize MotorQueen pages, or register with MotorQueen Services, a cookie helps MotorQueen to recall your specific information on subsequent visits to the website. This simplifies the process of recording your personal information. When you return to the same MotorQueen website, the information can be retrieved, so that you can easily reuse the MotorQueen website features that you have previously customized. automatically accept cookies, but with settings that can be modified to decline cookies. If you choose to decline cookies, you may not be able to fully experience the interactive features of the MotorQueen Services or the Website.

6.0 California Law.

6.1 Sale of Personally Identifiable Information. Under Cal. Civ. Code §1798.80, if you reside in the State of California and use the Services, you have the right to request from MotorQueen a list of all third parties to which MotorQueen has disclosed personally identifiable information during the preceding year for direct marketing purposes. As stated before, MotorQueen does not and will not disclose such information for direct marketing purposes, and so no such list exists. For questions about this policy, please contact us

6.2 Do Not Track Signals. MotorQueen does not obey Do Not Track signals from a User’s Internet browser. MotorQueen’s suppliers that collect personally identifiable information through MotorQueen’s website (including Facebook and Twitter plugins) also do not obey Do Not Track signals from a user’s browser. MotorQueen makes no representations concerning a supplier that does not collect personally identifiable information directly through MotorQueen’s website. These disclosures are made under Cal. Bus. & Prof. Code § 22575.

7.0 Changes to Policy. MotorQueen shall, from time to time, update this Privacy Policy in order to better protect your data, to comply with changes in applicable law, and to meet any contractual obligations of MotorQueen, and will revise the effective date of the Policy when we do so. MotorQueen shall notify you, if you use the Services, of changes to this Privacy Policy, prior to the changes taking effect, via e-mail to your registered e-mail address and by posting the new policy on its website with a new effective date. It is your responsibility to check the Policy for any changes and to take note of the posted effective date. Your continued use of the Website or the Services after any updates to the Privacy Policy take effect shall be deemed to constitute your acceptance of the changes and your agreement to be bound by them, provided however, that such modifications shall not apply to any disputes arising prior to the effective date of the changes. Accordingly, you hereby agree that your continued use of the Website constitutes your waiver to contest the enforceability of any such changes (whether for lack of notice or otherwise). Please do not use the Website if you disagree with the provisions of this paragraph 7.0. Otherwise, your continued use is to be deemed conclusive acceptance thereof.
